What Is HIPAA and Why It Matters
HIPAA stands for the Health Insurance Portability and Accountability Act, a federal law enacted in 1996 that establishes national standards for the protection of sensitive patient health information. HIPAA requires healthcare providers, health plans, and their business associates to implement safeguards that protect the privacy and security of your protected health information (PHI), which includes any information that can be used to identify you and relates to your past, present, or future physical or mental health, the healthcare services you receive, or payment for those services.
Under HIPAA you have the right to know how your health information is used, who has access to it, and how it is protected. Healthcare providers who handle PHI are legally required to provide you with this notice and to follow its terms.
Who We Are
Full Body Pharmacy Inc. is a functional health practice operated by Monica M. Guirguis, PharmD, a licensed Doctor of Pharmacy. As a healthcare provider we are required by federal law under HIPAA and applicable state pharmacy regulations to maintain the privacy of your protected health information and to provide you with this notice of our legal duties and privacy practices.
Applicable State Pharmacy Law
In addition to HIPAA, Full Body Pharmacy Inc. operates in compliance with Tennessee and Georgia state pharmacy regulations governing the confidentiality of patient information.
Under Tennessee Code §63-10-212, a pharmacist is protected from liability when disclosing patient information to authorized prescribers where necessary to identify and resolve drug-related problems, assist in obtaining a comprehensive medication history, prevent drug abuse or diversion, or provide medication therapy management. This is a limited immunity provision — it does not authorize disclosure to the general public and does not waive any confidentiality protections.
Under Tennessee Board of Pharmacy Rule 1140-02-.01(6), a pharmacist is required to respect the confidential and personal nature of all professional and patient records and shall not disclose such information to anyone without proper patient authorization, except where the best interest of the patient requires it or the law demands it.
Under Tennessee Board of Pharmacy Rule 1140-03-.01(4), as a necessary healthcare provider, a pharmacist may communicate with licensed practitioners regarding unexpected or adverse responses to drug therapy and work collaboratively to support comprehensive management of a patient's pharmacy-related care.
Full Body Pharmacy Inc. adheres to all of the above provisions in the handling of your health information.
How We Use and Disclose Your Health Information
We use and disclose your protected health information only as permitted or required by law. The primary ways we use your information include:
For Treatment: We use your health information to provide functional health consultations, develop personalized care plans, review medications and supplements, and coordinate your care over the duration of your program. Where necessary and in your best interest, we may communicate relevant clinical information to your authorized prescribers or healthcare providers, for example, to identify drug-related problems, resolve adverse medication responses, or support comprehensive medication management. Any such disclosure is made only to the extent permitted under HIPAA and applicable pharmacy law.
For Operations: We may use your information for internal practice operations including quality review and program improvement.
As Required by Law: We may disclose your health information when required to do so by federal, state, or local law.
We will not use or disclose your health information for any other purpose without your written authorization. You may revoke any authorization you provide to us at any time in writing.
How We Protect Your Information
Your health information is handled exclusively through HIPAA-compliant platforms including Malla and Spruce. We do not communicate protected health information through unsecured channels. Our Google Workspace account is used for general business communication only and not for the transmission of protected health information. All third party platforms used by Full Body Pharmacy Inc. maintain their own HIPAA-compliant privacy and security standards.
Your Rights Regarding Your Health Information
You have the right to:
Request a copy of your health information held by Full Body Pharmacy Inc.
Request corrections to your health information if you believe it is inaccurate or incomplete
Request restrictions on how we use or disclose your information
Request that we communicate with you in a specific way or at a specific location
Receive a paper copy of this notice upon request
File a complaint if you believe your privacy rights have been violated, without fear of retaliation
Licensing Disclosure
Monica M. Guirguis, PharmD is currently operating under a Georgia pharmacy license while Tennessee state licensure is being obtained. All services are provided in full compliance with applicable Georgia licensing requirements during this transition period. Clients are informed of this status prior to beginning any program.
Complaints
If you believe your privacy rights have been violated you may file a complaint with Full Body Pharmacy Inc. or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
